Change of DPS

How to change the DPS on a premises licence

If the Designated Premises Supervisor at licensed premises is changing, the Premises Licence holder will need to submit an application to vary the licence so that the new DPS is formally named.

A change of DPS is separate from transferring the Premises Licence to a new business or licence holder.

When Do You Need to Change the DPS?

A change may be required when:

  • the existing DPS leaves the business
  • a new manager takes responsibility for the premises
  • the current DPS no longer wants to be named on the licence
  • a business is taken over and the new operator appoints a different DPS
  • the existing DPS can no longer act in the role

The application is made by the Premises Licence holder to the licensing authority responsible for the premises.

Does the New DPS Need a Personal Licence?

Yes. The incoming DPS must hold a valid Personal Licence and must consent to being named as the DPS.

What Documents Are Required?

  • consent from the incoming DPS
  • the required licensing-authority fee
  • any additional notifications or documents required by the licensing authority

How Quickly Can the New DPS Start?

There is a procedure that can allow a DPS variation to take effect immediately where the relevant requirements are met, rather than waiting for the full process to conclude.

The exact process can depend on the application and the licensing authority, so timescales vary.

Common questions

Changing the DPS in Practice

Can a premises have two DPSs?

No.

A Premises Licence can only specify one DPS at a time. Other members of staff can hold Personal Licences, but only one person is formally named as the DPS on the Premises Licence.

Other Personal Licence holders can still authorise sales.

Does the old DPS have to agree?

No, the new DPS does.

The incoming DPS must consent to being appointed. The outgoing DPS does not have to remain involved simply because they are currently named on the licence.

We provide the consent form and guidance for the incoming DPS.

Is changing the DPS the same as a transfer?

No.

Changing the DPS changes the individual responsible for alcohol sales. Transferring the Premises Licence changes the licence holder. If a business changes hands and the new operator is also appointing a new DPS, both applications may be required.
